Ukrainians will not have to pay a penalty for the debts of housing and communal services

In the near future, the penalties for late payment of rent and payments of utility services will not be charged.
 
In the local executive authorities they claim that it is impossible to enter penalty for late payment of utility services from February 1, since the government has not yet developed a mechanism for its calculation and collection.
 
In addition, the Government has not yet determined the rate of interest.
 
Recall, December 14, 2010 the Verkhovna Rada allowed to levy a fine since 2011, repealing a temporary moratorium on its charge, which was introduced by Parliament in November 1996, by the law N2795-VI.
 
This was done in order to encourage citizens to pay for utility services in time.
 
Until November 1996, the penalty had been charged at the level of 0.01% for each day of delay but not exceeding the outstanding amount.
 
This rate is determined by the Cabinet, and the penalty was charged by Oschadbank - at the time it was the only bank taking the payments for rent and utility services.
 
Now the document, that would regulate the amount, does not exist.
 
The first bills for payment of utility services and rent taking into account the penalties should be formed in early February.
 
However, according to the Head of the utilities of the department of economy of Lviv city council Lesya Bodnarskaya, the regulation, explaining how to calculate the penalty, has not yet been in possession of the city.
 
"Its size is included into the draft of the Housing Code (0,1% of debt), but it will be adopted no earlier than in March"- said Bodnarskaya.
 
According to the spokesman of the municipal enterprise "Kharkiv Heating Networks" Tatiana Chuykova, the development of the mechanism for its collection at the state level is also expected in Kharkov.
 
"As soon as this mechanism appears the penalty will be charged"- said Chuikov.
 
In Donetsk, additional clarification was requested from the Cabinet. "Who will charge a penalty, keep the records - anything has not yet been known.
 
And what should the people do who receive a monthly salary in two installments: they receive money after the 25th, and the penalty will be charged from the 20th", - said the Head of the publication of accomplishment and public service of Donetsk City Council Konstantin Savinov.
 
In Kyiv City State Administration the situation was solved in a special way by typing differentiated tariffs from February 1: for the citizens of Kiev, paying their bills after the 20th day of the month, the rate will be higher.
 
The chairman of the Standing Committee of Kyiv City Council on Housing, Yuri Cooper, ("Civil asset of Kiev") believes that its introduction was forced: "Collection of penalties with the absence of public procedures immediately provoked protests by taxpayers and law enforcement bodies".
 
The press service of the Ministry of Regional Development, Construction and Housing reported that a specially created working group is developing techniques.
 
However, the process is slow, because the situation in the country has changed since 1996: "In particular, it is unclear which law body will charge penalty fees.
 
This can not be Oschadbank because you can now pay bills in many banks".
 
Nevertheless, the agency expects to finalize the procedure until February 20 when the first billing period of 2011 ends.
 
According to the press service of the Ministry of regional building, the size of penalties and the procedure for charging at the legislative level will be established prior to the adoption of the Housing Code by amending the laws.
